I have read all the info in this thread, but I have not seen any info on whether you can apply again if already been turned down for a visa and turned down for a waiver.
As I have previously mentioned by partner was convicted of ABH over 10 years ago and applied for a waiver 4 years ago and was turned down. Is this a permanent refusal or can he apply again?
1.) Al86: If you've never been arrested, then what in the world is the issue? Forget it ever happened.
2.) iwannagoamerica: There are no hard and fast rules and since no one here has ALL the facts of your case then no one can give you a definitive answer. What is stopping you from simply reapplying again?

I have read all of the above but was just wondering if someone could help me out. We are from Ireland and hoping to go to Las Vegas for my 21st.
My Boyfriend is 24 years old but when he was 20 he was caught for drug driving( smoked some weed before driving) he however was not in possession of any substances. He was arrested and had to attend court and received a two year driving ban and a few fines which h has completed but now just has an endorsement on his license, He didn't go to prison or anything!
I was just wondering does this come under "driving offense" or "drugs"?
Do you think we should ring the embassy, make an appointment and see? Or just book the flights and go to the airport?
It's just I would be skeptical about ringing the embassy in case they say no?
When you get your card on the plane do you tick no for criminal convictions?
I'm just a tad confused..? :P

My brother (27 yrs) has just been arrested for a crime, which I am sure comes under moral turpitude. He has pleaded guilty and is due for sentencing in August. Hopefully he will get community service or a suspended sentence.
I live in the USA and wondered what the chances are that he will be able to come over for my wedding in April next year?
I know it's a long shot and feel it's even longer since the crime is so recent.
Any advice or help would be appreciated as he has never been in trouble with the law before (no one in our family has) and I am completely in the dark.

Even if you read all the posts on this topic, you would still have questions! Basically, the UK has not shared its criminal database with US Immigration. Immigration does not have your criminal record on their computer screen. It is a self reporting system. You tell them what you have done in regards to arrests/convictions. Canada has shared its criminal database with the US and the US has shared theirs with Canada. If your brother is Canadian, he will not get in. If your brother is UK, EU or another countries citizen, he may get in.
I think there are 3 options: Your brother stays out of the US. He applies for a US visa, is told NO and stays home. Use the VWP and tick NO to all arrest questions and hope it goes well. This website might help. Click on 'answers'. Good luck.
