But someone I’m traveling with has a caution under battery she was never arrested. She was just cautioned she has an approved Ester . Are we okay to get in.

When someone accepts a caution they make a legal admission that they are guilty of the offence.

'Battery' is a more serious form of assault.

Without knowing all the details of the offence...and we neither want nor need to know them... it's impossible to say whether the person should travel with an Esta or should apply for a visa. It is the details of the offence which are relevant to US law.

>Are we okay to get in.

If the person is taken for secondary questioning...which can and does happen at random..he/she should answer all questions honestly.

If a person is taken for secondary questioning or refused entry anyone else travelling with him/her isn't prevented from entering the US (asuming everything else is ok, obviously). They have to wait for the person landside and officers will update them if necessary.

Hi
new to this not sure if this is the correct way to start a thread/conversation.
my question is, do the US Embassy interviews for D160 tourist visa, always drug test or require medical examination, if the person applying has an old, 17 years ago, non custodial conviction for possession of cannabis. if this is the case, are you told when scheduling your interview?

Happyrunning:

The way you started your post on this existing thread is fine.

No and no.

The decision to require a medical exam, which may...and usually does.... involve a drug test, is based on all the details of each individual applicant. The interviewing officer at the visa interview makes that decision, working within US law & internal guidelines and regulations and in consultation with superiors if necessary. There is no way of knowing in advance whether a medical exam will be required for an individual applicant.

Btw, it's a B-2 tourist visa. The D160 is just the application form.

I'd suggest if you're having a medical, you make sure there are no drugs in your system. And if that's a problem for you, you have a bigger problem as it implies that you won't be able to do without them for the duration of your American trip. Which could give you a whole world of trouble.
